1 Who We Are

ZynkCommerce is a Shopify app developer that builds tools to help merchants grow their online stores. We publish apps on the Shopify App Store under the ZynkCommerce brand.

2 Information We Collect

From Merchants (Shopify store owners):

• Shopify store domain and API access token (required to operate the app)
• App settings and preferences you configure
• Email address, if provided for notification features
• Billing plan status (managed entirely by Shopify)

From Shoppers (visitors to merchant stores):

• Anonymous session identifiers (randomly generated, stored in browser localStorage)
• Interactions with app widgets (such as clicks, selections, or inputs)
• Shopify customer ID, only if the shopper is logged in to the store
• Product or page context associated with the interaction

We do NOT collect:

• Shopper names, email addresses, or personal contact details
• Payment or financial information of any kind
• Precise location data or IP addresses
• Browsing activity outside the merchant's own store

3 How We Use Information

We use collected information solely to:

• Deliver and operate the features of our apps on your store
• Display merchant-facing analytics and insights dashboards
• Enforce plan-based usage limits where applicable
• Send notifications to merchants who explicitly enable them
• Improve the reliability and performance of our apps
• Respond to support requests from merchants

We do not use any data for advertising, profiling, or selling to third parties.

4 Data Storage and Security

Merchant settings and shopper interaction data are stored in secure, encrypted databases hosted by reputable cloud providers. All data is transmitted over encrypted SSL/TLS connections.

Anonymous session identifiers used to track shopper interactions are randomly generated tokens that contain no personal information and cannot be used to identify an individual.

We apply industry-standard security practices including access controls, encrypted storage, and regular security reviews.

5 Data Sharing

We do not sell, rent, or share any merchant or shopper data with third parties for their own purposes.

We work with reputable third-party service providers for infrastructure, hosting, and email delivery who process data solely on our behalf. These providers:

• Are contractually bound to protect your data
• May only use data to provide services to ZynkCommerce
• Are not permitted to use your data for their own purposes

Billing is managed entirely by Shopify and governed by Shopify's own privacy policy and terms.

6 Cookies and Local Storage

Our apps may use browser localStorage to store anonymous session identifiers on shopper devices. These identifiers:

• Contain no personal information — they are randomly generated strings
• Are used only to provide consistent app functionality within a browser session
• Are not shared with any third party
• Can be cleared at any time by the shopper through their browser settings

7 GDPR Compliance

All ZynkCommerce apps are built in full compliance with Shopify's mandatory GDPR webhook requirements. We handle all three required data requests:

• Customer data requests — we provide all data associated with a customer upon request within 30 days
• Customer data erasure — we anonymize or delete customer-linked data upon request
• Shop data erasure — we permanently delete all merchant and associated shopper data when requested

8 Data Retention

We retain merchant and shopper data for as long as an app is installed on your store. When you uninstall one of our apps, data is retained briefly for compliance purposes and permanently deleted upon receiving a shop redact request from Shopify.

You may request immediate deletion of all your data at any time by contacting contact@zynkcommerce.com

9 Children's Privacy

ZynkCommerce apps are business tools designed for Shopify merchants. They are not directed at children under the age of 13 and we do not knowingly collect personal information from children.

10 Changes to This Policy & Contact

We may update this Privacy Policy as our apps evolve. We will notify merchants of material changes via email or an in-app notice. The "Last updated" date at the top of this section will always reflect the current version.

Continued use of any ZynkCommerce app after changes are posted constitutes your acceptance of the updated policy.

1 Agreement to Terms

These Terms of Service ("Terms") govern your use of all applications ("Apps") published by ZynkCommerce on the Shopify App Store. These Terms apply to all merchants who install and use any ZynkCommerce app.

By installing any of our Apps, you confirm that you have the legal authority to bind yourself or your business to these Terms.

2 Description of Service

ZynkCommerce develops and maintains Shopify applications that help merchants improve their store performance, understand customer behaviour, and grow their business. Each app's specific features are described on its individual Shopify App Store listing.

We may release new apps, update existing apps, or discontinue apps over time. We will provide reasonable notice for any discontinuation of a paid app.

3 Plans and Billing

Our apps may offer free plans and paid subscription plans. Plan details and features are listed on each app's Shopify App Store page and within the app itself.

All billing for paid plans is processed securely by Shopify. We do not store or process any payment information directly. Your subscription is governed by Shopify's billing terms in addition to these Terms.

Paid subscriptions renew automatically unless cancelled. You may cancel at any time from within the app. We reserve the right to change plan pricing with reasonable advance notice to affected merchants.

4 Acceptable Use

You agree to use our Apps only for lawful business purposes and in compliance with these Terms and Shopify's Partner Program Agreement. You must not:

• Attempt to reverse engineer, decompile, or extract source code from any of our Apps
• Abuse, flood, or deliberately manipulate any app feature or data collection mechanism
• Use our Apps to collect or process data in violation of applicable privacy laws
• Resell, sublicense, or transfer access to our Apps to any third party
• Use our Apps in any way that could damage, disable, or impair our services

5 Intellectual Property

All ZynkCommerce apps, including their code, design, dashboards, and associated materials, are the exclusive intellectual property of ZynkCommerce. All rights are reserved.

Data generated by your store's shoppers through our apps belongs to you as the merchant. We process this data solely to deliver the app's features to you.

6 Data and Privacy

Your use of our Apps is governed by our Privacy Policy above, which is incorporated into these Terms by reference.

As a merchant, you are responsible for ensuring your use of our Apps complies with applicable privacy laws in your jurisdiction, including obtaining any necessary consents from your customers.

7 Service Availability

We work to maintain high availability of our Apps but cannot guarantee uninterrupted service at all times. Planned maintenance, updates, or circumstances beyond our control may occasionally affect availability.

Storefront-facing features that operate through Shopify's Theme App Extension infrastructure are hosted on Shopify's own CDN and are generally unaffected by maintenance on our backend servers.

8 Disclaimer of Warranties

9 Limitation of Liability

To the maximum extent permitted by applicable law, ZynkCommerce shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use our Apps.

Our total cumulative liability for any claim arising from your use of our Apps shall not exceed the total amount you paid us in the three months preceding the claim.

10 Termination

You may stop using any of our Apps at any time by uninstalling them from your Shopify store.

We reserve the right to suspend or terminate your access to our Apps if you violate these Terms, with or without prior notice depending on the severity of the violation.

Upon termination, your data will be handled in accordance with our Privacy Policy and Shopify's GDPR requirements.

11 Changes to These Terms

We may update these Terms as our Apps and business evolve. We will notify merchants of significant changes via email or an in-app notice. The "Last updated" date above reflects the most current version.

Continued use of any ZynkCommerce App after updated Terms are posted constitutes your acceptance of the changes.

12 Governing Law

These Terms shall be interpreted and governed in accordance with applicable laws. Any disputes arising under these Terms shall first be attempted to be resolved through good-faith negotiation between the parties.
